Drink Driving. pleaded guilty..

    I pleaded guilty even though i never even drove/ attempted to drive my vehicle. I had no choice. i cant afford 2,500 euro Fine if found guilty after fighting case plus i cudnt appeal it, solid 2 years.

    I got 2 years off the road. 250 euro Fine.. can appeal after 16 months i think..

    Anyways...
    Is this gonna affect me if i wana go to America next summer or anything?
    J1, Visa...etc?

    did you have your keys in the ignition ? was the engine on?

    Id prefer not to go into detail. Its over and im getting on with my life.
    imo it doesnt matter, i never drove it, keys or no keys in ignition. too hard to prove that when the odds are completely against you..guards word over yours..

    so does it go on my criminal record? Its not like i robbed a bank or anything..

    You are usually asked to declare any criminal convictions when applying for amy time of US VISA.

    Saying "I don't want to go into detail" is not helpful here as US immigration will take you aside and ask for details each and every time you cross the border.

    So if you want a helpful response on boards.ie post the details. Otherwise ask your solicitor.

    Do a seach of the whole site for "moral turpitude".

    Depending on the circumstances, you may be allowed a visa after interview and/or additional documents.

    It does indeed go on your record. Drink driving is a serious offence, the Americans may well view it as such too.

    Drink driving is not a crime of moral turpitude.

    So if asked the question "have you been arrested or convicted of drug trafficking or a crime of moral turpitude?"

    You can answer "no",

    If they ask were you ever arrested, tell them yes and that it was for drunk driving.

    Thank you all for replies.

    Ok well at the end of the day, to the judge I'm Guilty.
    I never fought the case. Keys in the ignition never came into the picture, so i prefer not to bring it in. I'm Guilty and i admitted it. Thats all anyone will see. I did crime, im doin the time.
    Not like anyone will believe i didnt drive it either, especially when im a stranger wantin to enter their country.

    Anyway im just wondering cuz i want to go to america either in 2 summers or in 3 or 4 years. I just don't want this holding me back. Thats all ;)

    also: keys in ignition, i can say no, theres no evidence they were in the ignition. so no they werent. they wud hav been in it cuz its automatic when u hop in, to leave them in it. i didnt even put the radio on, so the ignition was off.

    I think they lowered traffic offences as no longer criminal offences. Hard to believe but thats what the minister said on RTE news. You would not be a criminal but you might have committed an offense. The offense might not be such an issue. In fact an austrailian police officer once told me that when applying to be a constable she was asked about offenses etc and she had a traffic offense and it was no problem. If they wanted every detail they would ask on the from but they don't so the odds are in your favour.

    In substance, if you pay / return a fixed penalty notice, you are admitting to committing an offence. However, in return for the early plea, the state agrees not to prosecute you.
