Availablilty of court recordings

    I was recently involved in a case in the high court, a driving charge case and was wondering if anyone knows if i can obtain a court recording of the trial? thanx

    If its was in the District Court only the bare summary of details (names, address, dob, charge, conviction, sentence, etc.) has been kept.

    Other courts may have a transcript, there probably won't be a tape recording unless its associated with the transcript.

    Well...you said it was high court.

    If its circuit court in a civil matter there is no transcript unless one or both of the parties paid for a stenographer which is a private matter between themselves and you won't get a copy without their leave and without paying for it.

    If it was criminal on indictment there is a record by way of transcript which is furnished to the parties only in the event of an appeal.

    If it was criminal on appeal from district there is nothing.

    its a criminal case, dangerous driving causing death and was taken by the DPP thererefore not appealed.? It was a jury case.?

    Reloc8 warned for snide reply (not everyone knows a trial on on indictment is a trial that's in front of a jury).

    Apparently you won't be able to read this for a week, but when you come back and do, if you read the thread again, you might agree that you've taken insult for no apparent reason. I don't know if you're somewhat disappointed that you won't be able to get a transcript but that's nothing to do with me.

    For the avoidance of any doubt whatsoever, this is not a reply to gabhain7's post (as I don't propose to discuss disciplinary measures in public posting), its a reply to browne111.

    To make this post on-topic. I said 'on indictment means in front of a jury' in this thread. I was wrong - a person could be tried in front of the Special Criminal Court on indicment - that would not involve a jury. I just wanted to correct my error.

    Anyway, seeing as how I'm here now *prepares spleen for venting* :

    I decided that I wanted to appeal gabhain7's decision that he would warn me for being snide and unhelpful as it was complete and utter bs, to which I am allergic. I answered the OP's question, returning to complete the answer when he/she raised another query arising from my original answer, lazily quoting myself and supplementing that post with a further explanation.

    Gabhain7 directed me to nesf and Scofflaw as category moderators for the Soc Forum. He told me that he and the OP had interpreted my comment in this post as being snide and unhelpful, and that a warning was 'the lowest form of sanction available'.

    Personally I think being snide and unhelpful should attract a heavier sanction. In any event the reference to it being 'the lowest form of sanction available' seemed to me to imply Gabhain7 wanted me to sort of let it pass by. I could be wrong - you'd have to see the whole pm, which I'm not going to post here (I only posted the warning here because its sort of standard form - except for the bit that says 'you are being a warning' - I presume that's original on the part of the source of the pm.

    I contacted the Category Moderators several times since, copying Gabhain7 as a matter of courtesy with the pm's and have not heard anything since, beyond one query which was to the effect of not having received the original pm.

    Anyway, it now seems I have the following options :-

    a) do nothing and accept Gabhain7's warning.
    b) despite not wishing to do so originally (discuss this moderator's eh efforts publicly), bump the thread and make this post.
    c) deploy my knicker-detangler and pretend none of it happened.

    Seeing as how I got no response to my pm's I opted for b and made this post.

    In closing, the warning given to me was (a) innacurate as my post was thoroughly helpful and (b) presumed the worst of any interpretation available, that is if you even think it was possible to construe it as snide in the first place.

    Obviously, my take on the warning is that its a nonsense, albeit an irksome one; my thoughts on the handling of the aftermath are similar. I also think that Gabhain7 should have been man enough to revisit his original thoughts on the post and admit he made a mistake, whether his initial decision to warn me was based on insecurity, bad judgment or simple human error - hey it happens.

    He decided not to and directed me to the category moderators. That went no where.

    Hence this post.



    Now that I have gotten that off my chest I can deploy my knicker-detangler. I know, I know, too late. Oh well.
