Damaged Item From Ebay

I bought a video game from a seller on ebay. The item was listed as being in excellent condition and there was no mention of any damage. I received the item in the last day or two and the box is quite battered. There's a chunk missing from the lining on the right side of the box. The clips on the inside that keep the instructions in place are broken, 3 of them I think, and there's no hanging clip. The instructions, leaflets and cart are in good condition though. To be honest I think it may be a different box than the one that was listed. Maybe they were switched or something.

I've contacted the seller now outlining the damage. I fully expect them to blame the damage on the postal workers or that it was damaged in transit and not accept any blame for it.

In this situation, what can I do if the seller refuses to replace the item? Should I contact ebay if I get a negative response? Is there any hope of getting compensated in some way or getting a replacement box if the seller blames the damage on the postage? I bought this with another game and the other game is exactly as listed, no problems with it.

Basically, I just want to know what I should do next if I get a negative response. The item is damaged and the value of it is definately brought down. I have never had this kind of problem when buying from ebay so I have no clue really.

How much are you talking about and does the game work?

When he said it was in excellent condition, he could have been referring to the game, not the box!

Well wait and see what the seller says. He might offer a partial refund. You could open a dispute but if its just the case that's damaged it might not be worth the hassle.

The game works and we're not talking about much money.

It is mentioned here in the listing that everything is in excellent condition.

Considering that seller's feedback I'd be surprised if he didnt offer a partial refund.

Just to update this - I contacted the seller and they offered me a full refund or they'd send me a new box. I decided to just get a new box instead. It should arrive in the next day or two I imagine.

    I guess I shouldn't have assumed the worst. I couldn't help it. :p
