Maybe losing job

    Hello, I'm not sure if this was covered (and assume it may have) but cannot find any related threads. Working as a labourer but company is having trouble paying wages (about 6 wks behind with no sign of pay). I do continue to work but without pay but this is where I have some questions:
    * if i quit will i get redundancy ? I've been with the company about 7 yrs so even the 2 wks per yr would be something.
    * can I ask my boss to make me redundant since he cant pay the wages ?

    If all this does work out how do I go about getting paid. I heard on the radio that some company (name unknown) had sorted >1000 disputes in 2009 but cant find anything online on this. Any help appreciated.

    If you are owed money the "rights commissioner" will be able to sort some of it out for you. I think you get a quarter or something like that. Google it for more information.

    Thanks guys, I'm probably correct to say that contacting the "rights commissioner" would ensure that my boss wont make me redundant to allow me to get some much needed cash.

    If I contact the "rights commissioner" would I be guaranteed to get paid or could I be working for the next 6 weeks (unpaid) while its been processed..

    In the same position as you OP, we spent 9 months getting drip paid and then it was sorted for 3 months, now back to sq one again, very frustrating with no real help on what to do.
    You can't just leave as you can't sign on, the social welfare tells me that they deal on a per case basis with situations like this, so they can't say if I will get social paid up without having to wait 8 weeks.

    I think companies are deemed insolvent once they can't pay monies.

    Also our buck has been given us payslips which I am now been told he shouldn't have been doing.

    thanks for the response Yop.. would you go to the rights commissioner ? I dont see any way out of this.. stay working and get a drip feed.. quit and wait 8 weeks.. lose lose really

    Its an akward situation really, I am circa 1.5 hours drive from the nearest available job so its not going to be easy to have to count in 3 hours driving per day now but its something that I probably will end up doing.

    In saying that I am 3 yrs here so will get 4k redundancy IF things are wound up, but based on past performance the owner hasn't a clue so is too stupid/sly to consider the rest of us and do the right thing!¬
