DSR and USB key question?

    I bought a usb key online in the hope it would work with my old xbox. It didn't so I placed it perfectly back in the packaging that it came in. It's as new except the top of the plastic packaging is gone. The key was never used. Am I entitled to a refund under the DSR in this situation? I thought not until I bought the current issue of ComputerActive which has a "know your rights" article.

    It says that the product may be examined and the vendor cannot stipulate the item be returned in its original packaging.

    I've contacted the vendor and am waiting a response but would be interested in some feedback...anybody else have this problem?

    As far as I know, if it was advertised as a USB key, and functions correctly as a USB key, then you would not be entitled to a refund.
    However, if it was advertised as a USB key compatible with Xbox and it isn't then you should be able to get a refund.

    Well that's wrong anyway...you get a cooling off period no matter what the problem is or what it was advertised as.

    To return something under distance selling rules, you need to have not opened or used it. If the packaging is opened, then they don't have to accept the return. You also need to pay for the return postage yourself, which might make it not really worth while.

    If it was sold as Xbox compatible, and isn't, that's a different story.
