Accident...we're both insured by the same company.

    I was recently involved in a road traffic accident. (I was rear-ended)

    The person that hit me is also insured by the same company I am.

    There was some damage done to my car, and also I’ve since developed some continuous pain.

    Given the fact that we're both customers of this same company....and that insurance companies never want to pay up, but yet they have an obligation towards me….should I be careful in what I say, do…what info I give them?

    Any experience /advice of the above would be greatly appreciated.

    Be careful if they decide that it was a case of 50:50 fault and you both lose your No Claims bonuses, which is what the lazy insurance companies do.

    You should really have you pain assessed by a doctor and also talk to a solicitor.

    They will be breaking their backs to have this settled for the least amount of money possible.

    This kind of thing happened to me once and what I did was I kept telling them about my pain, they sent me to their doctor and then gave me a price to make a full and final settlement. I told them I though it was worth a lot more than that and that I would think about it. They rang me back and I told them I was thinking about going to my solicitor to see what he said and they offered me more money.

    so I said to myself that I would wait and see how I felt in a few weeks and I also looked at the PIAB website as it has a book of quantum and an estimator which helped me put a price on it. I just remembered that I was in the driving seat when the accident happened and I was still in the driving seat when I was dealing with insurance company. I just kept telling myself that I was the one that was wronged not the insurance company. If they had annoyed me in anyway I would have gone to my solicitor

    agree with this ..... be careful and dont let them give you a quick payout - especially as you are developing injuries post accident.

    Goto your doctor and get your injuries assessed and talk to a solicitor (I have sent you a PM on this already)

    I've been in a similar situation except it was a single vehicle accident - a tyre blew on me several years ago, car was written off and I was brought to hospital in an ambulance (semi-conscious)

    .... insurance company were paying out within 2 weeks - which seemed like a very fast payout, at the time I didnt realise it at the time but I had damaged a previously injured shoulder from a bike accident a couple of years previous - however a couple of weeks later my shoulder began to really iritate me.... the discomfort was getting stronger and I couldnt think of when I could have hurt it .... apart from the accident, I discussed the matter with my doctor and he agreed that its possible that I could have injured my shoulder at the time when my car was written off and the discomfort was made more noticeable by the cold weather.....Anyway - the point is that the insurance company just told me that the case was closed and they were not willing to discuss the matter further.....basically F**k off.

    OP... goto doctor, get yourself assessed first (your health is most important).... then goto solicitor.

    pcphoto you cant sue yourself so if you were not driving you should have gone to your solicitor

    If he has a comprehensive policy it could cover personal injuries he received while driving (even if no one else was at fault and it was due to his own negligence). He could sue his insurance company for breach of the contract of insurance if they didn't pay up.

    This is an action that requires a PIAB authorisation, since it is an action for recovering damages for personal injuries as a result of a wrong, that is a breach of contract.

    I have never come across a comprehensive motor policy which covers injuries caused to a driver as a result of his or her own negligence. I am interested in insurance and was wondering do you know which insurance companies offer this type of policy. [/FONT
