drink driving, what do next??

    I have recently bein done for drink drivin and im a bit unsure of whats going to happen about it, basically i went out one night during the summer, i had a good few drinks that night, i left my drink down in the toilet (stupidly enough) not thinking anything of it and i couldnt remember what happened around an hour or two after that i had around 6 or 7 drinks nothin to hectic but from the hours of around two until eight that morning when i was arrested for drink driving i havent a clue what happened, i was very (groggy) drunklike when i was arrested...... it is completely out of character for me to do something like this in the whole to years of me having my car, i swore i would never get in to it with drink in me... i have a feeling my drink was spiked.

    So basically i smashed the car and was arrested for drink driving, i made a statement when i was out of it which i shouldnt have.... dont remember what i put on the statement, i am now bein charged for "driving a vehicle while their being present a quantity of alcohol that exceeded that of the drink driving limit three hours after being arrested" their was 75 milligrams of alcohol per 100 of breath so i was a little bit more than twice over.

    I've been told i will get it back in a year and a day if i appeal it and and the guard who arrested me said he wouldnt stand in the way of an appeal... does it have to be a year or whats the situation on this...

    Im up in court in a few weeks and would appreciate comments on this, i dont know the legalities of it.

    And get the best legal rep you can, ya gonna need it.

    Go to a solicitor.

    At your reading your minimum ban is three years (it could be higher - if there's been an accident there may be more charges).

    The year and a day thing in your case is nonsense.

    Stop talking to the gardai - they're only doing their job.

    Go to a solicitor. Your case is serious - its not a run of the mill drink drive case - go to a solicitor.

    Go to a solicitor.

    i smashed the car no one was injured nor was i luckily, it actually wasnt on the summons about the smash not even anything about dangerous driving jus drink in the system!

    Get a good solicitor.

    Either way, you're looking at a suspended license for a few years (min 3 years). Some judges are really cracking down on drink driving, so you may be penalised even more.

    As for the 1 year and a day ... I doubt you'll be that lucky, considering what you posted here, (over twice the legal limit and involved in a crash). Hopefully you'll learn that you can't drink and drive.

    Bottom line - get a solicitor.

    Memory lapses are a not uncommon effect from drinking alcohol.
    i had around 6 or 7 drinks nothin to hectic but from the hours of around two until eight that morning when i was arrested for drink driving i havent a clue what happened,
    Still way to much to drink before driving. And those are the drinks you remember.
    i was very (groggy) drunklike when i was arrested......
    No uncommon in an accident situation. Adrenalin and shock will do this to you.
    i have a feeling my drink was spiked.
    Most people who claim to have had their drink spiked only have alcohol in their system. Maybe you were spiked with alcohol, but that is unlikely. Now, there have been cases of guys having their drinks spiked recently, but I imagine you did get home to find all your valuables missing. I take it that there is no blood or urine sample to demonstrate there was nothing else in your system.

    Twice the limit is much more drink than two times what it would take for you to be at the limit.

    There are certain minimums. there is little in the way of mitigation. How you behave between now and the court hearing is your only chance to minimise the damage. Accept responsibility (subject to your solicitors advice) and demonstrate a willingness to change - claiming it was spiked does not do this. Go get alcohol counselling. Stay sober. Keep your head down. If you don't have a job, get one. If you can't get a job, find some voluntary work. Pay for any damage caused when you crashed. I'm sure your solicitor will have some more pointers.

    thats a whole new kettle of fish..
    some do some dont, there are pedal assist ones that look like scooters,
    not the bicyles with electirc motor ones, they suck,
