Copyright infringement?

One of my photos was recently used on a publication without permission. It was not credited and was altered slightly. The picture features on my website with an All Rights Reserved notification attached and I can only assume it was taken from there.

I have contacted those involved but appear to have been fobbed off. I intend to charge for the use of the image, but can I charge for breech of copyright, or does that have to be carried out in a different manner? Can I charge for B.O.C at all?

I hope this doesnt count as asking for legal advice, I merely want to know what mare the usual ways in which this is carried out.

    Cheers.
