Hi to all you distinguished and learned peoples.

To cut a long story short, the has been a lot of fly tipping of all sorts of rubbish (nothing with names or addresses in it) on a piece of land of mine. Now, the County Council widedened the road about 4 years ago and took part of the land. In the verbal agreement with the county engineer was that a gate and fence be erected to prevent people accessing the forest by car. This was never done despite repeted reminders.
Now, there is no way someone could dump bags of rubbish on the land unless they could drive up into it via the small road the council was to fence off and put a gate on.

So, where do i stand, i know i have to remove the litter (includes dirty nappies, newspaper with dog poo on it and rotten meat ) but are the council responsible in any way?

Also, if a person is caught dumping rubbish or even walking a dog without a leash, are you obliged to give the warden your name and address like you have to give a Guard?

    Thanks in advance.

Yes, but they do not have any powers to arrest or detain a person so in theory you could simply just walk away.
