    Well while he had a point he was obviously just going out of his way to be a nuisance! At the same time saying hes "not trying to be difficult"!

    You have to emphatise with the officers, the journo has obviously went through the statute with a fine comb and went out with the intention of challenging this in my opinion and of course the officers cant know every statute inside out so its understandable that they might not know the complete ins and outs of their rights!

    To sum up, the journo was being an ass!

    Serious muppetry by the city police,

    they have obviously never heard of this thing called google streetview.

    Classic example of how powers granted for "exceptional circumstances", can be used routinely for petty things

    R (Gillane) v. Commisioner of Police and Secretary of State [2003] EWCA 2545 (Admin) rejected a judicial review of a police officer using a section 44 power but had this to sau on the challenger under the european convention:
    If there were any question of the police using these powers as part of day-to-day policing on the streets of London there would be considerable force in this submission.
    We are, however, concerned with a threat greater than any that this country in general, and its capital city in particular, has ever faced except in time of war. Assistant Commissioner Veness and the Secretary of State used their powers after taking into account expert assessments of the threat posed by terrorist activity and the risk that that threat would become a reality in London. We consider that this provided the necessary justification for any violation of the claimant's rights under ECHR Articles 8(1), 9(1), 10(1) or 11(1) that might otherwise be established. The exercise and use of the power was proportionate to the gravity of the risk. It was also prescribed by law. Mr Davies did not press his clients' case under Article 5. There is therefore no need to say more than that we are not satisfied that rights conferred by that Article were breached.

    I agree.

    While it is a not an offence to photograph in a public place and photographers should not be hassled for taking images, having watched the clip I am of the opinion the journo set this confrontation up.

    He came across as a grade 1 antagonistic ass in my opinion.

    For all anyone knows, there may have been intelligence concerning a threat to that building. Seems there were way too many security/police around anyway.

    Still this is the kind of stuff you must expect when you pass these kinds of laws. I think the journalist was a bit of a dick but at the same time I think fair play.
