Problem with Seller on EBay!!!

    On November 4th I purchased 2 watches from a seller (with a good rep). Payment was immediate. I am in Ireland, the seller is based in the US. The package was distributed, and arrived in Ireland on November 12th.

    Two weeks later and I was still to receive the item. I contacted the seller and he emailed me the tracking details. I contacted the Dublin Mail Center, and after doing a bit of searching, they found that the item was returned to seller (posted back to US) on November 13th. No reason specified, but the guy I spoke to said that this is usually as a result of the buyers address being ineligible.

    The seller is now in possession of the watches again, but also my money. I asked for them to be sent on again, to which the seller asked if I could pay the $33 postage again. I felt this was unreasonable, as I had done everything on my end by the book (instant payment, provided correct address etc).

    I said I didn't want to pay postage again, so he said he would refund me, but only the value of the watches, and not the £33 postage. Surely it's the sellers responsibility to get the item to the buyer!!

    What should I do? Transaction was done through PayPal so maybe raise a dispute there? I have already mentioned to seller that I will do this. That was several days ago, and I have heard nothing back yet.

    IIRC, EU Distance Selling Regulations would require the seller to refund you the full amount but that wouldn't apply to this US seller. I can see where the seller probably thinks it's unfair that he has to pay for shipping that didn't work properly but it's also unfair for you to pay for it. I'd say raise the PP dispute and see what happens. The seller will have to provide proof the item was delivered (which he doesn't have).

    I would raise a dispute tbh... youve already paid postage, its the sellers responsibility to arrange delivery to your address not yours!

    It's certainly an awkward one. I have a feeling it's a case that neither of us are at fault (maybe DMC), but after all he is the seller. I would have assumed he may have had postal insurance of some sort seeing as this type of transaction is dealing with fragile/costly items? I brought this up with him in email and he didn't say anything back regarding it.

    Anywho, I've just opened up a PP dispute so we'll see how it goes. Cheers for the info. I'll update when I hear back.

    Escalate the dispute to a claim, since you've already been in touch, and he's not playing ball.

    The customer is not just king these days, they are the Supreme Ruling Overlord Master and Commander so you should be entitled to your shipping charges back as well.

    When you say "ineligible" does that mean the address doesn't exist? I must say, I thought all sellers did the same thing, print out the details furnished by the buyer and paste that to the package.

    I would have asked him to detail the address he sent it to, and probably offered to meet him halfway on the postage if that seemed OK.

    I read that as "illegible" but I had to check how to spell it before posting :rolleyes:

    Woops, I actually meant that as illegible. :o

    He said he put my Paypal address on it alright, and also said it was still on it when it got back to him. Very strange though, as I've never had an issue like it before.

    I've had parcels returned before, problem is once someone marks the item as undeliverable and for return no one else bothers to check it. I tracked one parcel of mine to the An Post "lost property" office, it had been sent back as undeliverable from the UK dispite having the correct address in inch high letters on each side of the box (address checked on line with UK postal address checker) and my return address also on both sides of the box. The guy I spoke to just put a new tracking number on it and threw it back in the system, first time around two weeks to go no where second go arrived in 3 days? It was a heavy item and cost over40 euro to post and I got the money back from An Post as they couldn't explain why it wasn't delivered so I suspect your guy in the US can claim his postage back. It may have got lost at the An Post end but it is still the responciblity of the original US carrier and not An Posts in this case.
