    Does anyone recall if anyone in history ever publically sued for the unacceptably poor conditions of roads in a county or even town or is there legislation in place to prevent this?

    Im not specifically referring to claims for damages caused by poor road conditions, but rather for the general condition of the surface of roads

    Yes unsucessfuly, Brady v. Cavan County Council [1999] IESC 49

    Supreme Court held that although the Council was under a statutory duty to upkeep the roads it would not order it to do so. The reason was the Council had to act within funding provided by the Oireachtas and the court could not order the oireachtas to increase the funding given to it.
