    Recently put down a deposit on a car advertised on carzone by a Dublin based dealer. When I went to view it I was told the previous owner of the car was still driving it and it would be sold through the garage for peace of mind/warranty etc.

    Thought it odd that a garage would be advertising a car they do not own but I met the car owner - he is good friends with the dealer. He had originally purchased the car from the same dealer.

    So long story short I shook hands on price with dealer and have a receipt for deposit paid, was waiting on them getting car valeted and an electrical fault cleared, when tonight i get a call from the owner.

    He tells me he has hit a curb and broken a fender and it's 2-3 weeks till he can get it sorted, and he would now prefer to sell it privately as he does not want a six month warranty hanging over him!! wtf?

    The whole thing does not sit well with me now and think I should just walk away?

    I'd leg it, if he's not willing to give a warranty, then there must be something else wrong with it the dealer doesn't want to fix. Plus an accident repaired car can be hard to shift if not repaired properly.

    Phone the garage. Tell them that you want the money back. It was not advertised correctly.

    tyour intitled to your deposit back now as the terms have changed ie the garage is no selling it to you and d amage has happened to the car

    also don't give people deposits

    I'm a motor dealer (not in Rathmines!) and I often let friends advertise on my website. They dont give warranties, and as such have to advertise them like that (no warranty, private sale, etc etc). Just walk away - I hugely doubt you'll have an issue getting back your deposit, it's just bad luck for the vendor at the end of it...

    To prevent any complications let them know:

    1. You cannot afford to wait the few weeks to get the car back from repair
    2. The new damage to the car alters youropinion of the sale, you are not getting what you originally saw
    3. You have spotted an alternative car & you wish to proceed with that one intead

    I woudl not do this over the phone, call in in person to prevent the whole thing dragging on. I very much doubt the dealer will give you any hassle giving you your deposit back...unless he is a cowboy!

    Oh yea, I wouldn't be too concerned about a dealer selling a car for a friend (or loyal customer). Seen loads of it & we will probably see a lot more in the future.

    As posted by some other members i cannot see a problem arising in the refund of your deposit in this case. But i agree you should go in and do it in person.

    As I understand it the seller is walking away from the deal here? Does it not therefore follow that the garage have no choice but to refund the deposit as they cannot supply the car?
