bad judgement

    i was in court last week, up on a minor taffic offence. i was one of the last to be called up so i witnessed nearly all of the other offence's. the minute the judge walked in to the room you could see he was in a bad humour. i could not believe the sentences he was handing out ,niether could anyone else. he was giving people 6 months for little or nothing and handing down 1000euro fines for the least little thing. there were jaws dropping all around the court.i was a nervous wreck thankfully mine was struck out cause i had all my documentations, but i cant help but feel sorry for some of these poeple, its hard to believe a judge can ruin someone's life just because there in a bad mood probably over an arguement with the wife or something silly like that. has anyone else ever expierienced something like this???????????

    its about time these judges got some sense and handed out real sentances. too many wrist slapping and let em out to do the same again types judges out there.

    A judge can't just sent someone to jail because he's in a bad humour. There are restrictions in place, min/max sentences depending on the crime etc. If the crime warranted a 6 month sentence, then fúck them.

    or maybe the garda/road authorities was not doing their jobs right? maybe there had being no need to even bring the matter into court? maybe summons were sent out when they should not have being (eg, within no insurance document physically on one's person (for varoius good reasons) at the very time of being stopped but had went to the station to report and produce same) maybe penalty points and fine were paid on time but were not recorded? maybe garda didn't bother turning up?

    It was a minor motoring offence and it was struck out by the Judge, no conviction.

    He is not a criminal in the eyes of the judge and the state, so lets not be abusive by calling him one.

    Well, there is a process where people can appeal unduly harsh sentances. I think it's called the appeal process.

    They can appeal any sentences they want, appeals process.

    I was going to try a witty response, but I can't. Mind is sore from deceiphering that.

    I know a guy who was banned from driving for 3 months because he stopped in a double yellow box in the centre of Dublin during rush hour. The guy lost his job because he lost his licence.

    Bit harsh imo.

    Well, he shouldn't have lost his licence then, should he? If he'd been driving properly, and paying attention to the rules of the road, he'd have been fine.

    So for something so so minor that affects hardly anything.. Doesn't put anyone in danger but simply inconveniences one or two people.. A 3 month ban is justified in your eyes? Simply because the Judge can?

    If you are blocking these, you are blocking traffic.

    If you are blocking traffic, you could be blocking ambulances/fire service/AGS, who when having to negotiate through traffic come across more than one fool blocking traffic on a daily basis.

    So your "inconveniece" turns into something more serious.

    Don't block yellow boxes. Thats the law. Personally, I'd give three months for the offence and crush your car for being a numpty.

    So everyone who comes before the courts is always guilty of the offence they have been charged with (and probably some other stuff which didnt come up too) ?

    In that case why do we bother wasting money on judges and courts at all ? Lets just have everyone suspected of an offence by the cops sent directly to jail sure wouldnt it be a whole lot simpler...............

    yes, so did i, but they did not say that to me in this situation,so i thought nothing more of it til i got a summons in my letterbox.

    I know how easy it is to drive in slow moving traffic, lived and drove in Dublin for 4 years. I also know how easy it is to BE AWARE of your surroundings. When it comes to driving, it really rattles my cage at how bloody ignorant we are in this country of decent driving practices.

    Nae problem, Armin. (I did come off a bit abrasive to you.) As I said, its one thing that really gets on my wick. I'm fairly liberal when it comes to anything else.

    It happens all the time in on the Quays, because its let happen. I know it is a crime without intent, BUT its showing that they are incapable of motoring with due care and consideration for themselves, their surroundings, and other motorists.

    If they thought that they'd lose their jobs, then maybe they wouldn't be in such a "rush" to get nowhere, and hold up everyone else! But I digress, possibly I should take it to the R&R.

    Back OT, OP, 6 months for little things, and €1000 fines for hardly anything. Little things and hardly anything are subjective. Care to illustrate?

    You do not go to court for not having insurance documents at a checkpoint.
    You are given 10 days to produce.
    That you went to court shows that you did not produce your documents and therefore you are a criminal because you obviously did not produce your documents on time. That is a criminal offence.

    On a lighter note, the last time I was in court there was some hippie dude with a top saying "The only difference between Irish bankers and American bankers is that American bankers went to jail".
    I was the first called up (excluding those who didn't show), so I didn't get to see what he was up for.

    Anyway, I'm back on the 8th of January for not having a tv licence. This should be fun.

    sometimes, many go to their nearest station within the 10 days and for some reason our fine boys in blue fail to record the attendance correctly. human errors can and do occur!
