extemption from the income levy

    I know that all the medical card holders are exempted from paying the income levy

    I was let go recently, and didin't apply for a medical card. even if I apply now it is very unlikely they will issue one before the end of the year

    as I worked during the year mostly pt I didn't get paid more than 15k I reckon

    now the question: if I wont apply for a medical card, would I still be able to get an income levy refunded?

    If your income for the year is less than 15,028 p.a. then you would be entitled to a refund of any levy paid. Revenue would issue this refunded for 2009 after the 31st of December 2009.
    Check your P45 and see what your Gross income was. If it is below the amount stated then you are entitled. :)

    Regardless of income, when you have a medical card at any stage during the year, your exempt from the Levy. If you've got an Income Levy Cert from your former employer with your P45, I'd send it into the Tax Office, and state that you have a Medical Card, valid from whatever date it issues to you.

    This is where you send your P45/P60 to check if you are entitled to a refund of prsi. ( taken from www.welfare.ie )

    Where an employees weekly pay fluctuates above and below €500, but the annual pay during 2008 is not more than €26,000, the employee may claim a refund of the 2% Health Contribution deduction.

    excellent, but doesnt answer mu question at all. even if I apply for a medical card now, there's no chance I will get it before the end of the year, therefore will not be able to claim the income levy paid this year

    I am on dole at the moment, so I don't understand how relevant is the second part of your answer

    gerrybbadd - good point, I wasn't aware that an individual is entitled to a refund of Income Levy if they hold a medical card at any stage during the year.

    Does anyone know it there's any flexibility on Revenue's side in regard to making a claim for a levy refund?

    If, like in this case, an individual has been working during the year and paying the income levy and subsequently becomes unemployed for whatever reason and so entitled to a Medical Card, will Revenue allow a claim for a refund of income levy paid (based on the date of umemployment and so entitlement to Medical Card) even if the card has not issued before year end???

    Hope my question is clear :rolleyes:

    Revenue's position is, if your due a refund of the levy during the year, and employed, the obligation is with the employer to refund you.

    If you finish work, and send in your levy cert, Revenue will send it back, and ask you to resubmit it in the new year, upon which time a review of your tax affairs will be carried out. ( This is regardless of entitlement to the Medical Card )

    This is slightly misleading, according to pgh 2.23 of this PDF file available here- the employer only makes adjustments at the end of the year IF you are in employment with that employer for the entire year. As this doesn't apply to the OP, the Revenue Commissioners will make any refund adjustments after December.

    Additionally, as noted in that pgh, the levy is deducted on a 'week 1' basis ie the amount is calculated solely on the earnings in a particular week without any account taken of earnings in earlier periods. Accordingly, refunds won't arise until the end of the year and will be dealt with either by the employer (where you're with the employer all year) or by Revenue (in all other cases).
