Claiming and Owing Tax at the same time!

    I had worked full time up until June of this year when my contract expired. I was then unemployed until the end of September when I then emigrated to work in the UK.

    I had filled in a P50 and expected to claim around €1,500; however I only received €80 as I was in arrears from the 2007 tax year.

    The reason I was in arrears was that I worked for one employer for 9 months of the year with a 3 month break in the summer time, where I then worked for another company. It seems that this company did not underpaid tax me or an amount was refunded to me and thus was in arrears at the end of the financial year. When revenue became aware of this they promptly sent me a tax bill stating that my credits would be cut over the next three years to reclaim the outstanding amount. However, they have since simply taken the amount from my tax reclaim.

    In my P50 I did state that I was emigrating for an unknown period of time but did check with my local revenue office, explaining my situation and was told that my claim would not be affected.

    I have contacted revenue and requested that I repay the bill over three years via a direct debit method from my account in England (with a Irish guarantor in place) however they will not accept. My issue with revenue is that taking €1,500 from me now is not the same as repaying it over a three year period as previously agreed, and secondly, it was not as if I fiddled the books to pay less tax in the first place – it was something my employers should of picked up, so I’m feeling pretty aggrieved that I’m being penalised.

    If I did not have the money to repay and I was still based in Ireland, or even if I was abroad as I now am, I’m sure revenue would of pursued me and of agreed to some mechanism of repayment that allowed me to repay via instalments so I do not see why it can not be applied to my current situation.

    Does anyone know of any ground for appeal or has anyone been in a similar situation?

    I imagine they see you as a payment risk.
