Not displaying Insurance Disc

    For a car thats insured but not insuring their discs, can they be penalized by law? I know its an offence but i can't seem to find any legislation supporting my thinking and showing the punishments. Any help would be gratefully accepted. Especially if someone could link me to the relevant legislation :)

    which is an amendment of section 11 of http://www.irishstatutebook.ie/1961/en/act/pub/0024/index.html#zza24y1961

    These define the offense of failure to display insurance. Not sure where the penalties are spelled out though (i believe it's some sort of on-the-spot fine).

    you can get an FCPS for it, 80 euro fine.

    FCPS? Could you provide a link for this if possible

    Cheers dave. I had the road traffic act, didnt have the offences one. Seems a small bit out of date, but the fact it says theres a fine helps

    In general, if stopped, you've got 10 days to provide insurance at a garda station of your choice.

    The garda can give you a fine, most wont.

    Tractors, Motorbikes, Defence Force vehicles, State vehicles and vehicles displaying trade plates are exempt from having to display insurance discs.

    Well, in general, if you only just signed your insurance, you don't have a disc. That's why they shouldn't give you a fine, but require you to present your insurance within 10 days at a Garda station.

    I've had several cases, where I've been stopped with no disc just after buying a new car and never been fined, as long as I presented the insurance papers within 10 days.

    Check the statutebook there, and there is actually an excemption for exactly that case: S.I. No. 227/1986

    Section 5.1.
    A person shall not use a vehicle in a public place, after the expiration of a period of ten days commencing on the date of authentication of the certificate of insurance, unless the vehicle carries an insurance disc in the manner specified in sub-article (2) of this article.

    So, if you didn't display the insurance disc within the first 10 days after you signed the insurance, you can't be fined. However after that, the Garda can fine you.

    If a garda still gives you a fine in the case above, i'd take it with his super.
