I want to know how the law lies with a checkmate issue. The company has instructed a solicitor to demand a sum of money that was paid.
It cant be proved that the money was paid, but it also cant be proved that it wasnt. 3 payments were handed over that included cash and cheque but 1500€ has suddenly gone A.W.O.L, the solicitor has been told that it has been settled and that its nobodys problem but the staff who has made this human error. A new solicitors letter was sent with a list of invoices and only listing two payments. So now we are at a point where they say i do and i say i dont, what now.

Sorry I don't really understand your question.

A company is claiming you owe money...you say you made 3 payments of cash and cheque...the company through a solicitor says nope two payments only were made correct ?

Someone says you didn't pay them, you said you did - you need to go to a solicitor and get some advice on the particular situation.

I don't get the point about somebody saying (a solicitor) that it 'has been settled' and the reference to a human error.

If the initial solicitor's letter you received referred to three payments made by yourself, and the new one only two then this is supportive of you having made indeed three payments - all of that is a matter of evidence to be given in due course, by yourself, and whoever is dealing with it for the company.

Seriously, you need a solicitor - not an internet forum, at this point.
