Wishing to press charges against someone for assault...

    Hi everyone

    Myself and my mate got a dig last night, left myself with a fairly sore head this morning. We were in a nightclub and some guy gave me a dig. Now there is CCTV in the club, which I plan to use as I have the time and the area of the club it was in. Garda were outside but refused to take a statement cause I had had a few drinks (apparently you cant make a statement if you have???). Everything was completly unprovoked, no justification for it, not on, so hence, trying to do something about it.

    Questions:
    Do I need to make a statement? Do I have to call in to the station itself?
    I dont know who this guy is, but will the guards get to the bottom of that? All I would have is the CCTV as he was dragged out before I even got re-orientated!
    Is the club liable in any way?
    What else can I/should I do?

    Yeah they won't take a statement over a relatively minor matter like this if you're a bit the worse for wear on drink until you've sobered up.

    1) Yes you need to make a statement and yes call to the station.
    2) Who knows - he may never be identified. If you pointed him out at scene they might however have spoken to him and gotten his details.
    3) The CCTV is not gonna be preserved unless you and/or the gardai act quickly.
    4) Club liable - probably not unless the chap who apparently assaulted you should not have been let on the premises.

    If you want a prosecution to commence, go and make a statement to the Gardai. If you want the CCTV tell the gardai you think it may exist - to be honest you may be sadly disappointed to find it doesn't - those cameras by no means pick up everything. If you want to rely on possible CCTV in a civil case (although I doubt you have anything to go on here as regards successfully suing) go to a solicitor and they will know what to do.
