What rights do we have?

    Hi,

    First time poster! i was just wondering what kind of rights do we have to

    1. Privacy
    2 Jobs

    Ok a friend of mine was in a job he didnt particularly like, and he went for an interview with another place he wanted to go. He got offered the job yesterday and started, it was going well until today, they have terminated his contract because his they didnt like the background check they did on him.

    Now he has told me the only time he was in trouble, was this year when he received an adult caution, now i thought the whole point of an adult caution was a slap on the wrists and the they wouldnt show up in any background checks? He has checked with the Garda and this is true.

    So how can they first of all find out that info? and then sack him?

    He had an option of two jobs on Monday, now he has none.

    Did he sign a form consenting declaring any convictions when they got the job?
    If they didn't own up, then it's perfectly normal to get sacked as that's deceit

    Now even if there was no form, when applying for a job you can assume a background check will be done though it probably won't.

    I don't know about searching court records. Even if it wasn't recorded and the garda told you this would it have been in a local paper in the court report? Not sure if this is the sort of thing you go to court for

    I don't realy think this person has many options here unfortunatly

    he didnt go to court....and was specifically told when he received the adult caution he could go to court and make a big thing of it and probably get off or else take a slap on the wrists, ironically so he wouldnt have a court history

    A friend of mine started a new job this week where the employer has started to do background checks.

    She was away travelling for a yr and they have asked her for a copy of her visas and travel tickets and names of places and people she travelled with or stayed with.

    The company in question said that they have 100's of people wanting to work with them and so any liars would be caught out and their contracts terminated.

    I worked for this particular company before they started doing backgrounds checks and lets just say for a company to have such a high staff turnover in the middle of a recession says alot about its policies in general.

    However, if your friend signed a consent form I'm not sure if he can do anything about this.

    yes he gave consent, didnt sign a form, but the point i am making is that, if he was told that adult caution wouldnt be held against him, or that when background checks were held against his name, how did they find out?
