Fixed penalty charge

    Just looking for some advice here. I received a fixed charge offence letter today alleging I was parked in a loading bay on a road in Dun laoghaire last month. I am fairly certain I was not in Dun Laoghaire on that day nor have I ever parked on the road in question.

    My question is, how do I appeal this? And what other details does a guard take when they are writing the offence? Make/model/colour of the car? Or is it just the guards word against mine? If it's just the guards word, with no other evidence, I would probably not bother appealing. I just don't like the idea of paying for an offence I did not commit. Even if I was in DL that day, I have never parked on the road they mentioned, or even stopped on it for a few seconds.

    I would have no problem paying if I did park illegally, but I want to see more evidence if there is any.

    Write a letter to the superintendent outlining the reasons why you believe the FCPS was issued in error. If you have anything to prove that you were not in the area include details of that also. Include the details of the time of the offence and location and most importantly the reference number. Also include a copy of the FCPS notice.

    Do this ASAP because the time is still ticking down for the 28 days to pay.

    The supers office will forward to the issuing Garda for them to decide whether it was issued in error in which case it will be cancelled or whether they have the correct details in which case the FCPS will be upheld.

    same ting happened to me about a month ago for parking on double yellows in ranelaigh.i wasn't even in dublin at the time so i wrote a letter to the local super explaining this with a photocopy of the notice and a week and a half later i got a reply saying disregard notice,it was a clerical error.

    As Foreign said. Check the registration number on the FCPS and see if it is your own. It does happen where a clerical error can occur
