for the NCT, do i need a spare wheel?

and if i do put a spare wheel in the boot well, does it need to be a road legal tyre?

i have a spare wheel but the tyre is not legal, so i seeing if i leave it there or take it out all together.

You dont have to have a spare wheel for an NCT. Many cars do not come with one. If there is a spare tyre there they will check it and if it is not legal they will warn you about it but not fail you on it. Check the NCT manual for more information.

    http://www.ncts.ie/nctmanual.pdf

    TYRE CONDITION
    Method of Testing
    1. Check whether the tyre tread appears to have been recut.
    2. Check visually that the tyre is correctly seated on the wheel rim.
    3. Examine the tyre for:
    (a) any cut or break in the fabric.
    (b) any lump or bulge.
    (c) any exposure of the ply or cord structure.
    4. Examine the valve stem for distortion or chafing.
    NOTES:
    (a) It will not always be possible to see the complete tyre from ground level, especially on vehicles where the body
shrouds part of the tyre. In such cases the vehicle should be moved to expose the hidden parts of tyres, or the
examination should be completed from a position under the vehicle with the wheel in the raised position.
    (b) Examination is confined to tyres fitted to the road wheels.
If, however, any defect on a tyre carried on a spare wheel is seen, the driver should be advised

EDIT after looking through it again, in the section about thread depth it does not say that the test is limited to the road wheels so it may be possible for them to fail a bald spare. but if its not there they cant fail it

also a taxi is required to have a spare wheel and it must be a full sized wheel and not a space saver.

The last test I got done they didn't even open the boot never mind check the spare wheel inside. Was looking in the through window for the full test. That was just after the penalty points for no NCT came into full affect some months back so they were really really busy at the time and its not to say they wouldn't check the next time round.

See section (b) of the Notes you quoted!

Section B does say that but that is in the notes section of the tyre condition section. In the thread depth section it does not say that in the notes. So it may be possible for them to fail a bald spare, im not 100% on that. but the simple option is if you are in doubt take it out because if its not there they cant fail it.

AFAIK the only thing checked about the spare (genuinely) is that it is securely attached to the car
