Holiday pay

    Hi all, quick one on holiday pay entitlements..
    So the gf recently was made go on a 20hour flexi contract rather than a 40hour contract. Her hours haven't changed tho and she's been on 40 hours since.
    She was on holidays for a week recently, now her pay has come through and they've put through 20hours hols for her instead of 40.

    Isn't holiday pay based on previous weeks earnings??
    Or is it on basic contract hours?

    This doesn't sound right.

    To make things as simple as possible, if you get 20 hols per year, take it that your holidays should be 8% of total hours worked.

    Make a note of when the holiday year starts, work out 8% of all the hours worked since then. Then take away all hols taken before this weeks hols, if the balance is over 40hrs then they should have paid 40. Though it could be an over sight. Most companies pay the balance over your contracted hours at the end of the year.

    Ask how many holiday hours does she have left. Maybe at the time the hols were taken she only had worked up 20 hours.

    Did they pay her her hols when they ended one contract and started the other one?

    It's a retail company so they take 4 weeks holidays a year, so that was her winter holidays. She's not done less than 40hours a week since she started.
    It could be a balls up, the store manager's on hols for the week so she's gonna see what the craic is on Monday.
    Crazy situation if they try to stick to giving her 20hours hols.

    You earn holiday by working.
    So if she worked 9 months on a 40hr contract. 3/4 of her holidays will be at that rate.
    So if 4 weeks holidays per year 3 weeks at 40hr and 1 week at 20hr.
    Depending on the holiday year it could be different.
