Ebay seller asking me for advice?

    So I ordered a halloween costume on Ebay for my sister. I paid for EMS shipping so it would arrive on time. So I was tracking it on the EMS site and it arrived today. Except that instead of a Cat woman costume it is a fake iPhone worth 6 times more than the costume. The EMS number on the docket is correct, but it is a different one on the box, and this item arrived in America on Wednesday.

    I emailed the seller to tell him this and he said "Maybe this is a mistake? I check you don't recieve it yet, My Dearest friend,my god! i'm crying! what can I do now? please advice, thank you very much!"

    I asked him if he sold a fake iPhone and I gave him the tracking number from the box. He says he never sent any fake iPhones, so obviously it was EMS that messed up the 2 dockets, not the seller.

    I don't really know what to do now, and obviously neither does the seller. I have an item worth a lot more but I don't really want, my sister has no Cat Woman Costume and presumably some guy in America is looking pretty sexy but no iPhone.

    Am I still entitled to ask for a refund? What should I do with the iPhone?

    Any help is appreciated as it is a very strange situation.

    Claim your money back off the seller, and then they can claim off EMS. As for the phone, those are worth no more than $100, and are generally crap. Was there a return address on the box at all? Otherwise give it away, or bin it. It is not worth anything near the value of a real iPhone.

    No return address. Just an EMS docket for $224. I checked the tracking number for the phone. A Mr. Gonzales in America 90210 has a very sexy Cat Woman costume.

    It sounds like a scam.

    The zip-code 90210 is probably the most used in the US, it is the postcode for Beverly Hills and is so popular due to the fact that it included in the name of "Beverly Hills 90210"

    It is also highly unlikely that EMS would make such a mistake.

    The value on the EMS docket is also far higher than the value of a fake iPhone.

    You should report the seller to ebay immediately and have them investigate him

    I don't think that's it at all, because at the end of the day my purchase is insured through Paypal. The fake iPhone is a peice of crap, but is definitely worth more than a $10 costume.

    I told the seller that I wanted a refund and he asked for pics of what I recieved and the 2 tracking numbers.

    I checked the second tracking number and it was signed for by G Gonzales and is confirmed on the EMS web site.

    Sounds like some kind of scam to me. String him along and send him pics of the item. I'm interested in what he'll do next.

    Sending pictures, or doing anything else from your end, would seem kind of pointless at this stage. The sender has a tracking number for an item that was sent to Ireland, and a tracking website that says it was delivered in the US. That's a clear case for a refund from the postal service. All he needs to do is submit a claim, and also refund your payment, since you didn't get what you paid for.

    The fact that you got something else is irrelevant, as it didn't come from him (which he has told you) and it's none of his business what it is.

    Its easy enough for a Courier comapany to make that mistake. I had a package coming from chainreactioncycles that was mixed up with someone elses. The courier comapany put the wrong labels on the boxes.
