Distribution of rejected inheritance

    An uncle dies leaving 60 acres between his 3 nieces. He leaves nothing to his sister. One of the nieces has rejected her 20 acres. Is her 20 acres split between the other 2 nieces in the will or does some/all go to the uncles sister who was not in the will?

    If I remember correctly, anything left over undistributed will be dealt with by the residuary clause, if there is one.

    If not, it will be distributed on the basis of the rules of intestacy - it will go to the sister as long as there are no children (or their issue) or parents of the deceased in existence

    It depends if there is a clause in the will dealing with gifts that fail. If not it depends on whether there is a clause dealing with the residue of the estate. If not its distributed under the rules of intestacy.
