Question about renting

    We rent a 1 bed apartment, put down what was a standard deposit just under a year ago. There were some faults with the apartment which we brought up with the property managment company. We asked them about the marks in the walls and floors, they said not to worry about it they know what damage was done by previous tennants.

    We have a slidrobe storage unit that never opened proparly, it always derailed, but we did complain about it via phone. The handy man called out and said it was damaged by previous tenants and that he couldn't fix it. Because it was not fixed, the door derailed and cracked the glass in the door, this crack became bigger. We priced a new door to be about 300 euro, we are willing to pay for it, but should we? In my opinion I think the whole unit front needs to be replaced. Which could cost about 600 euro, I won't part with that much money for the damage we done.

    Our property managment people sent us an email a few weeks ago saying they were not managing the property anymore and gave the landlords name and number, this seems very odd to me. Any suggestions?

    I was told to say nothing, maybe the landlord will not see it and hand us our deposit back, how soon after we move out must our deposit be handed over? Is it on the day we move out when we hand over the keys? It is our first place to rent trough an agency, for the past 5 or 6 years every place we rented was laxidazy really. We will know in future from the mistakes we made in this place. Thanks for any info you may have :)

    I'll offer some experience of a dispute here, not legal advice...

    The landlord is supposed to return the deposit promptly on termination of the lease, unless there is good reason to do so. This is usually when they've had the time to check the property for any damage done above the normal wear and tear having regard to the duration of the tenancy amongst other things.

    You fulfilled your obligations in contacting the landlord/agency about the broken sliderobe, the landlord is then generally obliged to rectify the damage. There are instances where you can employ someone to fix it and send them the bill but we never encountered these so I cannot comment.

    If you are still in the property, take as many photos as you can and log everything that happens with the landlord on a word doc. or something similar - this will prove very handy if a dispute arises and is something we didn't have. Contact the landlord about the deposit if you haven't heard after 3-4 weeks and if there are any problems, contact the PRTB

    3-4 weeks? I wasn't going to hand over the keys unless I got my deposit back to be frank. I have emails of some things but not of everything. The complaint I made of the wardrobe was over the phone. We kinda need the money for our next place as we don't exactly have a lot of disposable income. I have no problem if he takes 300 for the broken door, but once he doesn't take the full 1200, because that would be insane.

    Regarding when you get your deposit back, depends on what your lease says. Most provide for a joint inspection process on termination of the lease, often within 1 month of termination or often just say 'prompt' return of deposit but not immediate on termination.

    A lot of landlords arrange to call over the day before you vacate and hand it over at that stage if no difficulties.

    The type of lease you describe is likely to be governed by the Private Residential Tenancies Board legislation - check their website for forms & procedures in case of dispute. Can be lengthy stuff.

    I agree taking good quality photographs is a good idea in any event.
