Setting up a Residents Association

    I'm helping to set up a Residents Association in the area I live in, and I'd like to ask the advice of the experienced members of this forum on a few things.

    First off a little background, the estate was set up by the developer and was meant to be transferred to local authority control about five years ago - this never happened so the developer has been basically mowing the grass ever since, no other maintenance. There was also meant to have been a set amount of money put aside from the purchase of each house which at this stage probably exceeds €100,000, being held by the local authority we presume. The estate also has a lot of students living in it, a minority of whom cause problems every year - one resident had her house egged recently for example.

    So basically any ideas on the following would be much appreciated:
    • Official structure for a RA that might be influencing the expenditure of the initial deposit with the local authority, and might be taking membership fees ultimately - charitable organisation, limited company etc.
    • Dealing with litter, there is a problem here with illegal dumping and its not uncommon to see bit of rubbish around the estate.
    • Getting the council to take full responsibility for the estate, who should we talk to, and once they do what exactly are they responsible for.
    • A step by step procedure for dealing with antisocial behaviour from students and/or children from a neigbouring estate.
    • What supports, structures and procedures should such a RA typically have, meetings, officials and so on.

    There's an article on the Apartment Owners website which might help.

    On the vesting issue, every local authority is required by law to produce a document detailing their taking it charge policy. Contact your council and ask for a copy of it. It should help you on your way. Generally they refuse (or delay) if there are outstanding service charges or if the estate wasn't built to taking in charge standard. There may be work left for the developer to do or changes that are required. It's a messy area. Start contacting your local councillors now so you'll have some support later. Get other owners to contact them too.

    If the estate is public (ie not gated), the council can prosecute anyone dumping litter. If you see it, ring the council and ask them to send a litter warden out. They'll go through it looking for identifying material.
