Bought item on eBay - not as described

    Ok,

    I ordered a pair of shoes on eBay, described as 'used' BUT 'only worn once, in excellent shop bought condition'.
    And the photo shown they look fine. So I bid, and win. Grand.

    They arrived today, packaged well etc. I open and find that the left shoe at the back where your heel would be (not the bit you stand on) is ripped with plastic support exposed/sticking out, and another rip in the fabric there too. Along with a couple of minor stains.

    So I email this person back explaining this. They respond saying there's nothing wrong with the shoes, they only wore them for 2hours and they're exactly as they bought them and sorry that our opinions differ.

    I respond saying that she couldn't have bought them in that condition as they are damaged and they'd cut me should I try to wear them. That I find it misleading and will she take them back.

    She responds saying there was nothing wrong with them when she posted them, that she feels describing them as 'used' was correct as not to mislead people into thinking they were new with tags. That she'll refund me half the money of the shoes if I'm really unhappy. OR that if I post them back to her, she'll refund the money I paid for the shoes ( not including any p&p charges either way).

    I have responded saying that it WAS misleading saying they were worn once and in excellent shop bought condition when infact they were damaged. I said I'd post them back to her (I'd pay the P&P charges) and she can refund me the full shoe & original postage price. (awaiting reply now)

    I'm just wondering is this what I am supposed to do? I am right in my request? Do I complain to anyone about this? I've bought many items on eBay and never had this much of an issue before so I'm honestly unsure how to act.

    That's it exactly. eBay will not make the seller pay for return postage, but they should refund the full amount, including the postage you paid to them. Start a Paypal dispute to make it all official, then escalate to a claim. The procedure is all listed there, when you start the dispute, and you should get your refund.

    She got back to me, she's very unhappy about all of this, insists she's in the right but that I'm leaving her no choice. That she'll refund me the price of the shoes& original p&p if I post them back to her. So I posted them off this morning. When clarifying her address she furthered to guilt trip me telling me all the fees she'll have to pay now.

    She won't have to pay any fees. eBay will credit the selling fees, and if she reverses the payment, Paypal won't charge either. Sounds like she's a stupid bitch who's full of sh it.

    I'd said about me paying the postage back to her, that way the loss was kinda 50-50 as we'd both paid postage.

    Its not really a 50/50 loss as sellers have to pay listing fees, final price fees and also paypal fees, and I imagine I'll have to pay paypal to refund as well :(


    which I felt was just unnecessary. I've posted them back this morning to her, when she gets them/refunds me - should I give feedback etc?

    She sounds like a total bitch to me, so just ignore her, you are in the right! They were not as described and so you are entitled to younr money back! I really think she should be paying your post back to her too! You seem like a nice person :D. I would defo leave negative comment on ebay!

    Tell her to stop imagining, and get her facts straight. When she does a refund on the payment, she won't pay any fees, nor will you when you receive it. She'll then need to go back to her auction and put in that both buyer and seller mutually agree to not go through with the sale, and eBay will refund her. She sounds like she hasn't a clue what she's doing, or she's a complete wagon and is trying to guilt you into not looking for a refund. Either way, she shouldn't be selling broken items on eBay, so it's all on her.

    Definitely leave negative feedback to warn others of her behavior, and the fact that she sells broken items and doesn't want to take responsibility for it. Also her lies about fees and charges.

    Cheers Jor el - you've been so helpful! And everyone else :)

    I'll wait until she gets them and refunds me and then I'll leave the feedback stating what happened. I'd just honestly never had such an issue, if something ever arrived in a damaged state the seller always apologised/offered a replacement etc so I was surprised to get guilt tripped. And you're right she shouldn't sell broken goods claiming them as otherwise. Thanks again, I'll do what ye've told me :)

    I posted them back on the 19th - got my refund yesterday.
    Left negative feedback today saying the item was damaged prepost, that I'd to argue for a refund and was made feel guilty, but that I had returned the item & had been refunded.

    Now she's emailed me the following:
    Why have you given me negative feedback????! Extremely unfair! It clearly stated no refunds, and I went out my way to accomodate you and make you happy! I refunded the full amount to make you happy but yet you've went and done that...why? If I'd know you were just going to leave negative anyway then what was the point? You made me feel extremely pressurised to refund you the full amount, so its not fair to say I made you feel guilty. I think you should retract your feedback as it doesnt reflect the truth.

    I have responded saying that she sold damaged goods and when I questioned her she was disputing it, and then continued to make me feel guilty by saying she'd have lots of fees to pay when that was a lie. And what had she expected me to say via feedback.

    I have done right by leaving the feedback I did haven't I?

    ^ You are completely in the right. Sounds like she's just one of these people who can't accept when she's in the wrong. She's the one who wasted time and money for BOTH of you.


    Also, I think it's very fair that you mentioned in your feedback that she DID refund, so I really don't think you should feel any guilt.

    Actually, you might point her in the direction of this thread to show how everyone is on your side.

    And btw, I can't imagine a more annoying damage to a shoe than the heel beel sticking into your foot - I've had that before- very very uncomfortable! I'd rather have a pair of shoes that were completely ripped to bits on the outside!
