Parking fine

Got a parking fine (Motorcycle) for wrong reg no, I was told it was not valid on the phone by parking company and the warden. The Warden said not to worry about it, fine will go to wrong person and be cancelled. Person on the phone said to write them (company) - with correct info and assured me they can't switch it. The parking fine was totally unjustified - but no one wants to hear that. Garda told me to contact the company and show them my bike and ticket in person.

Should I bother? I feel as it's unjustified it's not my mess to sort out...

How do you mean the fine wasnt justified? Your were either parked illegally or not?

If the fine has the wrong reg number on it how did it make it to your address????

Remember - Wardens usually take a picture of the offending vehicle.

I would just write to the company and say you are not the owner of the vehicle in question. Ask them to confirm cancellation of the fine.

"How do you mean the fine wasnt justified? Your were either parked illegally or not?"
I have looked up the act and it's not clear (Local Authority Traffic Wardens act 1975) - but I have no legal experience whatsoever. The alleged violation is on a public footpath, but was causing no obstruction.

"If the fine has the wrong reg number on it how did it make it to your address????"
It was stuck to mirror - with wrong reg in toe. It will make it's way to someone - not me - thats my point..

Didn't know this - thanks for info

I will call over to office and show them personally - I'll post back the story...

My issue is having to correct a mistake made by a warden and the fact to park 'legally' I am supposed to get a scratchcard like ticket which cannot be affixed (and take a car space?) - people with motorcycles have enough trouble trying to avoid tax disc robberies, parking? Forget it - I consider myself lucky to have even realised it was shoddily attached. 110% positive no obstruction was caused or inconvience to foothpath users it was well in behind a phonebox(door other side). The law from what I see is meant to stop motor vehicles mounting paths and being a nuisance to footpath users.

I have written to the local TD also to see what he says on the issue.

It is illegal to park on the footpath.

You don't say where this happened - there may be bye-laws.

It happend in Leixlip, Co. Kildare. I visited the office in Celbridge and was told not to worry about it by the same guy who issued it - as it's the wrong reg. Some other person will recieve it in error. I asked how to park 'legally' and was told to:

    • Use a full carparking space
    • not pay (as pay ticket cannot be affixed - but fines can?!?!)
By the Warden, as Kildare CoCo provide no facilities. This is sheer and utter joke in my book. I have emailed the company also to get it hopefully in writing that no action is required. The local TD is also looking in to this and rules/byelaws around it.

TD told 182/1997 sect 13 (1) & 36 (2) sub (i) apply. No doubt I was in the wrong, still leaves issue nowhere to legally park http://bit.ly/3Z2mrZ. He's promised to bring this into consideration in talking to Kildare County Council.

All I want is some sensible solution - taking a full car parking space - depriving them of revenue (as I was told not to pay - nowhere to affix ticket) is a hodge-podge that makes no sense. If your going to slap €40 on people - give them good options to legally park.. Also I raised issue of a friend of mine having an electric bike. Now people who click on the link will note "mechanically propelled" (great foresight) includes electric or other, but since it doesn't have a plate or tax it can't be fined.

Hopefully anyone who's ibn a similiar situation can find this and know the story of how to legally park!

Be lucky it wasn't in Dublin. It's illegal for a bike to park in a car space and there are no motorbike parking places provided:confused:

If you've been advised by the parking warden to park in a car space and not pay do this. It may force them to provide proper motorbike parking spaces when loads of bikes are parked in all their car bays.

The electric bike isn't considered a mechanically propelled vehicle (MPV) if they can only use pedal assist. If your friend has an electric bike that can be driven without the use of the pedals then they need tax, insurance, licence and helmet to use in public. If they have to use the pedals to move then it's not a MPV.
