Postdated Contract of employment

    Hi all ,

    My employer has just given us all employment contracts that are post dated to the date we started work (We never signed contracts when we started) .Mine is post dated by about two years.He wants us to sign them and return them to him , says its for insurance purposes ? Ive never heard of anything like this before , what do you guys think ?

    It's backdated.

    I have in the past signed a backdated contract, but the reason was purely disorganisation (personnel dept backlog or whatever). Maybe your employer is just trying to get things organised? I wouldn't be too concerned about it unless something new seems to be in there that you weren't aware of when you first started work, so you should read it carefully before signing it & ask your employer about anything that you feel uncomfortable about.

    According to Citizen's Information Website :

    Anyone who works for an employer in Ireland for a regular wage or salary automatically has a contract of employment, regardless of whether it is written or not.

    In my last job a lot of the guys on our workshop floor had never signed contracts, so I spent months trying to get agreements quantified and contracts signed. They fought me all the way, with many crying they would not be "forced" to sign any damn contacts.

    The company went into liquidation a few months ago, and it was hard to feel sympathy as all those without contracts got royally screwed by senior management and the liquidator.

    "I have thirty years of service!"
    "Really? show me the contract"
    "I am guaranteed overtime every week"
    "Really? show me that in your contract"
    "The company has always paid me for sick days, you should pay me now"
    "Really? show me that in your contract".

    So many people automatically think that their boss is out to screw them over, yet the person with most to benefit from having a contract is the employee themselves. Look at this case for example, the OP doesnt want a contract that is backdated to when he started working. He doesnt know why, he just doesnt want it. Never mind that that the backdated contract protects his length of service if it ever came to redundancy payments.

    I very much doubt the boss here is trying to screw you over, he just knows that every employee is supposed to have a valid contract. Read the contract, and if the terms are ok, I suggest you sign it.
