Company Name Usage Question

    Abit of a Long Story here, My Partnet was leasing Land of a couple and Setup a Equestrian Centre out on the land, she signed a 12 month lease etc came up with the name etc, after about 3 months the Landlord figured it was a profit business and decided to tell her he had a buyer for the land unless she can come up with X amount of money she had to leave (gave her a weeks notice) even though they broke the contract that doesnt bother her however the couple have been using the name she was using when she was leasing the land running it themself ( They are running it without insurance or Q Instructors) Anyway My Partnet Reg the Company Name with the CRO and I Registered the .ie Domain name + .net however they got to .com before i actually bought it, My Partner has found a new place to Rent and wants to use the same name ( The Company Reg with the CRO) Question is do the People trading under her company name have a legal leg to stand on, they have been advertising all over the internet etc, i got a phone call off the guy today i told him basicly we own the company name/domain and we are running a company from the 1st of November and want them to stop using the name and take off all advertising from the Internet etc, Are we doing the right thing by saying that or what is the situation? Obviously if we need to take legal action(thats if we have a case) then we will.

    What you're asking for is basically legal advice and you get that from a solicitor. The bottom line question is whether one person is 'passing off' their business as being, or as being connected in some way, to another person and causing that other person loss. That can't be answered accurately here.
