Making a complaint ?

    Hi guys,

    A few months back I was involved in a minor accident where by some idiot hit the back of my car and then drove off. I got his number though.
    I went straight to my local station and made a complaint (I got the Garda's name and recorded the time/date)
    A few months later and the insurance company is saying they cannot proceed as there is no record of the incident. Called the station and they say , nope, nothing on the system ?

    This is seriously annoying, considering the Garda called me that evening and told me about the visit they paid the guy, he denied driving off. So at the time I was basically told, impossible to prove either way, leave it to insurance companys.

    Is it possible he knew someone in a high position that could have wiped it ? Was the garda seriously incompetent ?

    What are my options here ?

    Before making a possibly career-damaging complaint against the Garda involved I would think that fairness and courtesy dictate that you should first contact that Garda as you have his details .
    Although the incident may not be on the 'system' that is not to say a record of it does not exist , for example the Guard may well have details of it in his notebook and although I'm no expert on Insurance claims it seems reasonable that such a record would suffice for insurance purposes.

    Having said all that I am not a Garda and there are others on this forum in a better position to advise you - call it ' my two cents worth ' .

    Write to the Superintendent of the location explaining the above, register the letter and keep a copy. Also try to contact the officer you dealt with and ask him why there is no record. Shouldn't the insurance company be doing this in the first place?

    Give it a week and if nothing comes back consider a solicitor or lodging a complaint with the Garda Ombudsman.

    Did you suffer a personal injury as a result of this collision?

    Contact the member before you do anything else, say it to him, he will be able to put it on pulse and get him to contact the insurance company. problem solved. if nothing happens after that then you can go for other options, but i would definatly advise you to contact the member first.
