legal height of hedges

    housing estate in west dublin and neigbour next door giving out about my hedge as it is to high. What is the legal height restriction on the height of a hedge. or can they go legal.

    Maybe some help there.

    As long as it's not overhanging someone elses property, and isn't dangerous, then I don't think there'd be a problem.

    If they are saying their light / view is being obstructed, it's not like the hedge shot up overnight!

    Hedge at the side of my house must be 15ft high on my neighbours side, and it doesn't bother me.

    This appears to have been commissioned in 2001 but not used to implement a law.

    But why do you want a high hedge ?. It will block light to your garden, cost a fortune to trim, & cause upset.

    No height restrictions per se.

    A Council used to have the power under section 44 of the old Local Government (Planning and Development) Act 1963 to order a landowner to cut a hedge. This power was however repealed in 2000 without being replaced.

    If it's a party wall hedge (i.e. its on the boundary), neighbor has right to cut it under section 34 of the Land and Conveyancing Reform Act 2009 when it comes into force (this December I understand). Any disputes can be decided by a district court judge.

    The Council as the right under the Roads Act 1993 to cut it if it interferes with traffic and the ESB can cut it under the electricity supply acts if it interferes with a power transmission cable.

    A neighbor can sue for an injunction that it be cut if its growth leads to a signifigant diminishment in the amount of light falling on his property. Note that the neighbor has a right to light and not a view.
