need advice on my rights

    I have been working in my job for over two years, It in the post office at the minute im in the middle of studying for a QFA exam that is necessary to work there.

    the day before my holidays i was informed when i came bck that i was to be transferred into the deli, i said i wouldnt but my boss said to think about it. So i went on my holidays and returned to work to see was the position the same they said it was so i handed in my notice, I went to into work to work out my notice and was told there was no work for me to do. so i left and i have heard nothing from them.

    I have just heard now that they have already employed someone else.

    Their reason for moving me was that hey wanted to reduce costs and they couldnt afford the staff in the post office, before my holidays i was on a 3 day week then told that i was to return to a full working week.Apart from the boss I am the only one who can open up close count the tills do the balance etc, so it just doesnt make sense to me. My thinking on it is that money went missing from the back office and they think i took it and are moving me for that reason, even though i have never or would never think about taking a cent.

    Do i have a case against them? if i were to claim the dole would they delay my claim? do they have to pay me because they didnt let me work out my notice?

    sorry for the long post im just confused and very angry at the way iv been treated..

    eh... why didn't you work in the Deli? Did you think you were too good for it or something? Can't believe you walked out on a perfectly good job, of course they've replaced you already, they probably had a queue around the corner of people who would be more than happy to work!

    no i dont think that at all, i worked in the deli for over 2 years while i was in college, me and the chargehand never got on, she was so lazy and never did her job properly, the management knew this but never did anything about it so i had to cover her and do stuff she was exppected to do but couldnt have been bothered or learn how to do.

    i just couldnt go back there!

    if i were to claim the dole would they delay my claim?

    The fact that you voluntarily left your job means you can't claim the dole for (I believe) 9 weeks.

    I went to into work to work out my notice and was told there was no work for me to do. so i left and i have heard nothing from them.

    Did you walk out because they said there was no work for you, or were you told to leave because there was no work for you?

    What if an IT manager was told he was being moved to first level tech support? He'd have every right to quit and claim.


    OP, go to your local social welfare office first thing Monday and apply for JSB/JSA.

    I thought you didn't qualify for the dole if you refused an offer of alternative employment? I'm getting my information from citizensinformation.ie

    So you work in the post office.

    Boss says he can no longer afford to pay someone in the post office and offers you another job.

    you refuse the deli job and hand in your notice.

    Your boss decides that there is no work for you in the post office and sends you home, (standard enough practice where someone has handed in their notice in unideal circumstances)

    Imo you would be entitled to be paid for your notice period and no more.

    Thanks for all your replies and i agree with the lecture part.

    But in all of this i found out they have hired someone new to take my position in the post office, yet they claim they couldn't afford to pay me.

    Can they do this?

    Yes they can, you resigned so they can fill that position any way they want.

    Why exactly didn't I know what I was talking about???? I simply couldn't understand why someone could walk out on a job when it's quite clear that there are going to be plenty of other people out there willing to take her place within minutes.

    And I'm sure jumping on the bandwagon to have a go at my post isn't answering the OP's question either.

    i handed in my notice
    The law states that they can't make you redundant, and then hire someone in for the same job. As you quit, I do not see why they couldn't rehire someone to fill the position that you left open.
