Question about patenting

    Hi,

    I’m thinking about setting up an online business that is a little bit different to what is out there at the moment. What I want to find out is what is the process of getting my idea patented? Do I go directly to a solicitor first or are there other avenues I should explore? I would appreciate if anyone would share their experiences of getting their product patented. What is the average length of time to get a patent or is each application different? Are there different patents for Ireland/UK/Worldwide? Any advice/help would be greatly appreciated.

    Patent are costly and timely to obtain. However I'm not sure an online business can be patented. See this article - http://cyber.law.harvard.edu/ilaw/mexico_2006_module_7_obmp
    It indicates that in US you now can patent a business method, but that was a court decision. Situation in Europe is different. See wikipedia article

    Just to let you know of my experiance here. I talked to a patent attorney a while back about getting a patent for an online system that we have. The really tricky part is that there has to be something that is unique in the way your site works, not just a unique idea. We didn't persue it any further.

    First place i'd be looking for information would be here: http://www.patentsoffice.ie/

    You'll also find on that website, a list of registered patent agents in Ireland. Presumably you could bang off a couple of emails to them stating what you want to do and if its not doable, they'll let you know quick enough i'd say
