commerical property, change of use?

    hi, if i want to change the use of a commercial property from retail to food... what does that cover.

    here's the deal, ultimatly i want to sell take out food... but when i was talking to the planning authority they said no to take out food... now, there's cafe's on either side of the place i'm looking at...

    they said a cafe or restaurant would be ok....

    so, here's my question, can i get planning for a restaurant/cafe, put a few seats in, and if people want to take the food away that's their choice.... i mean, if i go into either of the cafes presently there, and asked could i have the food/coffe to go.. i can't imagine being refused....

    mcdonalds call themselves a restaurant, but you can take their food away... so i'm just wonder..... can i just class it as a restaurant and sell food that the customer can take away?

    It's really all down to the definition in the category of Purpose Group.

    Purpose Group 5 (iv) is specific to Restaurant where food is eaten on the premises, whereas the only Purpose Group which seems to cover a dedicated Take Away would be Purpose Group 8.

    Also watch out for specific bye-laws which may appear to discriminate against the idea of having a Take-Away.

    if there is fixed available seating, its a restaurant.....

    generally, planning for a takeaway will only be granted if it is ancillary to a restaurant, unless a specific economic need exists. however, the restaurant should not be ancillary to the takeaway...

    cheers guys, some great advice...

    there's another premises i was looking at, but it's been let... and the estate agent let it slip that he managed to get planning for a cafe/take away... from the same planning authority.....

    how do i go about finding out the planning application for this place... i have the address...

    would this work in my favour... if they've given planning allready... or is it better to try a softly softly approach?

    the impression i got off the estate agent was that you gotta play to their tune...
