    Hi everyone! I was caught doing 130km/h in a 100 zone earlier (yes i know i shouldn't have been) but anyway the guard just took my name and address off my license and said i would get a fine next week!
    Is this right?? Shouldn't he have proved i was over the limit and shouldn't i have had to sign something.
    Also he was on his own in the car.....i was told there had to be two of them in the car but that could just be a load of rubbish!!

    That's right.
    He doesn't have to prove it, if you think he should..enjoy court.(fwiw, don't do this, it's a horrible experience)
    You don't have to sign anything.

    Call a solicitor if you think you have a case and you want to dispute it.

    A Guard does need to have a minimum amount of evidence to prosecute, unfortunately even broken uncalibrated speed detection equipment is enough under current legislation.

    yeah your friend is right, there has to be two of them and they have to be wearing their hats too :rolleyes:

    Its an overtaking lane to start with..but i cant see how they cant slam on the breaks..any other car driving could do it also..im sure tho that if another normal person driving pulled out in front of them and slammed on the breaks they would have no problem saying twas illegal!

    You can then defend yourself by saying
    'never received the fine, your honour'
    A friend of mine saw loads thrown out, as the judge said, unless the gardai can prove that the fine was delivered, it holds no weight in court.

    This is no longer the case due to a recent circuit court ruling. The gardai only need prove that the letter was posted.

    How do they prove it was posted, as it's not registered? Do they have pictures of someone sticking them in a post box or do they just bring in an empty stamp book and say your notice was the 5th stamp used?

    Have we now got to the stage where you can be convicted of an offence without proof, a Garda can testify that they formed an opinion you where speeding or use an calibrated detection device, and no evidence that they even posted the original notice?

    Yes.

    Then again... the Gards aren't out to get you. Nor do they simply make everything up just to look good or even hit targets that often. And post doesn't get lost that often... at least not without a little "help" from the receiver :P
