Sky installed direct by sky or independent agent

    Folks,

    Just a quick one, if you have sky installed by an independent agent and your box develops problems and you need a new one, is agent responsible for replacing box or will sky resolve this issue for you?

    How old is the box? It may still be under warranty. Contact Sky and see what they say.

    You have a 1 year warranty on your equipment from the agent

    Another question, if your box packed it in after 6 months are you entitled to a brand new box or just a new reconditioned one in a brown cardboard box??! Is there any difference between how independent agent and sky handle this problem??

    Both will only replace with refurbished boxes.

    Sale of goods act says repair or replacement so it depends on who is doing it. Sky normally use a refurb

    Used to be replaced by new boxes but this is no longer the case, our suppliers decide on what we can and cant do...simple as that.....9 times outta ten its a refurbished box they supply....

    Thanks lads...

    This is what my installer told me, Im getting a pace box in today and we will try this stacker/destacker out! Ill let you know how it works.

    I was a little concerned when he told me, it would only be a refurb box that I would get should my own give probs and just wanted to check this out.

    Anyway, lets hope for the best!

    heres the problem though, the independent agents rely's on the wholesaler to carry out a repair or replacment and so far the wholesalers are insisting on one year only and not complying with the eu legislation. In skys case they will most likely charge for a service call at such a rate that its the price of a new box anyway, sky have no retail presence that you can physically bring a box back to.

    I've just looked it up and it seems the 2 years part was not implemented in the Irish implementation of the legislation.

    However the reason why it wasn't implemented, was that Irish law already has greater protection then two years. It seems that under the Sales of goods and services Act 1980 says that goods should last a reasonable period of time. Then under the Unfair Terms Regulations Act 1995 introduced a statute of limitations of up to 6 years.

    That isn't to say you have a 6 year warranty, rather, you could take action, for instance in the small claims court for up to 6 years after purchasing an item. It is then up to the judge to decide if it is reasonable or not, I'd imagine a Sky box breaking after 14 months wouldn't be found to be reasonable.

    Perhaps this is something that the new ISAA group should look to clarify with the wholesalers.

    Thats a pity, 2 years seems to be fair and its a hassle to have to go to small claims court and take your chances with a judge. A reasonable period of time is a very subjective term which is why i'm sure the EU went with a defined period.

    Agreed, but then on the other hand, if you bought a €2000 HD TV and it breaks after 3 years, you would be better off in Ireland.

    Fair point but should 2 years not be the minimum and then a small claims judge could dedide whats reasonable after that period.
