Firmware update for nano

Hey guys...just got my mate to bring me back a nano from Oz. Current firmware version on the nano is 1.02 while itunes is telling me 1.04 is available. However I don't want to upgrade in case Apple decide since my nano is in Europe it will apply the volume limit crap to it... Will it do that? Hell I probably don't even…
