Plese help, 2 months back i got stopped for driving without insurance( 100% genuine mistake, i work in a profession where a licence is required, insurance out by 10 days, rest assured it was a error on my behalf), the guard stated i would be in court before christmas. how long should i wait befor i get summoned. I am of the understanding that the garda has 6 wks to process the summons and it should be on the pulse system. I know that driving without insurance is againist the law and i dont disgaree, no insurance equals no job, hence it was an error.

Garda has 6 months to apply for summons not 6 weeks

If you got stopped 2 months ago (July), you could well be waiting a year to 14 months to actually recieve a summons for the incident.

As the other poster says, the Gardai has 6 months to apply for the summons and it usually takes another 6 months to actually recieve it.

One of the reasons is that there's so many cases in the system, you're talking a year or so from the date of the incident before you'll hear anything.

You should go and see a solicitor who is competent in the area of road traffic law. Conviction may not automatically mean losing your licence. You may also not be guilty. There may be a technical defence available.

They have to write it within 6 months, but can issue it to you anytime they want after that AFAIK.
