Entitlements after accident and continual reduction in pay?

    Hi All,

    I was wondering if someone could provide me with some helpful information specific to my situation.

    I had a Traumatic Brain Injury accident in late April. I'm well on my way to recovery and my ongoing rehab has been very beneficial.

    Obviously I'm not at work and won't be for the foreseeable future. However, since I am only receiving a much reduced basic pay package and have to hand over any sick pay entitlements to my employer, I was wondering if someone could please detail or suggest any other entitlements which I could claim for? My VHI pay my medical bills. I haven't claimed for anything else.


    Please correct me if I'm wrong but it seems that I'm not entitled to any welfare apart from illness benefit which I hand over to my employer on a weekly basis.

    I have been resident and working in Ireland for over 9 years. I am Irish. The accident happened in my own home and occured in mid April.


    Since ,my employer paid me my reduced base Salary until the end of June, 75% of my base Salary in July and August and 50% of base in September, afterwhich, they will cease to pay anymore and their insurance company will assess my claim.

    Can someone clarify the following please;

    * Please confirm that I'm not entitled to any other state benefit?
    * Shouldn't I be entitled to a refund of my tax credit allowance for September since I'll only be receiving 50% of my base pay (due at the end of September)??
    * Since my employers last payment to me will be at the end of September, if the insurance claim is accepted, should I get to keep the illness benefit (I've been paying it to my employer to date)?
    * If the insurance claim is upheld, will that payment be taxable or will I be entitled to a refund of my remaining tax credits for 2009?

    Thanks in advance for any help, comments or suggestions.

    If my questions are too specialised, then maybe I should contact an accountant, social welfare office and citizens advice bureau along with other specialist forums or sites to get as much helpful information as possible...

    As far as taxation goes perhaps the taxation forum might have some advise. Though perhaps its worth giving the tax office a call, anytime I've had to do it they've been most helpful.

    Thanks Rev Hellfire but I had all my queries answered by the Citizens Advice Bureau although, lke you, they also advised me to contact the Revenue regarding my tax questions.

    Appreciate your response though and I also found out today that the RTU provide a source of payment for expenses incurred for the duration of the course so things are looking better I guess.
