a family member bought one from a main dealership, when they had it 6 weeks it developed a funny noise, on checking the oil level, the dip tick showed empty, they topped it up, wwent to the garage the following morning, the garage said that it should have been returned without the oil being replaced.
the garage said upon checking it that a valve was sticking, after another 4 weeks upon checking the oil it again regestered empty, the dealership said again it was a valve sticking, they topped it up and asked for ot to be returned in another 3 weeks to check the oil level, now the garuntee is up, (3months) the owner is insisting that the garuntee starts again from the time it has left the garage the last time,
your thoughts please, thanks in advance.

Sounds to me like they were/are just waiting for the warranty to expire so they can avoid paying for repairs. Am fairly certain the warranty runs from day of purchase as well.

Problem arose while under warrenty, dealer action did not cure the issue, dealer is obliged to fix the car. Are they refusing to do it under warrenty ?

not exactly refuseing, just pushing a fix into the future, after 2 visits to a workshop it should be fixed, BUT is it, some one suggested when it was low on oil it should be driven up a mountain in 1st gear with the boot to the floor.
