Legal challenge to fees?

I remember some talk a while back about the Unions challenging the legality of a reintroduction of tuition fees... anyone know the stance they were taking, or how they would have argued in court if it happened?

AFAIK the argument was that there was a reasoanble expectation of free fees in the form of a contract between State and citizen for those who had already enrolled in the course.

I am not a lawyer, but I can't see it happening. The judiciary acknowledge that they're not elected officials and thus are very slow to spend exchequer money. With the little knowledge that I have I doubt they'd go against the usual stance on the fees issue.
