    Hi lads

Got 2 penalty points on M7. Was doing 140km/h when all of a sudden noticed familiar blue lights :D chasing me. Pulled over to hard shoulder. 'Sir you were running at 140 and you well deserve an award, show me your license'. and thats it.

Do i need to ring my insurance company and tell them. Would they charge any extra midway between policy.

You're going to have to tell them anyway. They probably won't change the premium until your next renewal. Best thing is to stick to the speed limit.

You need to check your policy documentation as it depends on the insurance company. As far as I know, you don't need to tell them until the points actually arrive in the post.

If these are your first points you premium shouldn't go up. Most companies only start penalising once you've four or more.

you dont have penalty points until you get the letter in the post and pay the fine or go to court.
You dont have anything to tell your insurance company until then.
Most companies dont give you any loading for 2 points but you have to tell them when you get them anyway

I got stopped doing 121 the other day and the guard said I would have to go pay the 80 euro fine that's it.
Got the notice in the post today and as well as the fine I will be endorsed 2 points.
Do I have an argument that the penalty was not explained to my correctly and dispute the points or can I forget it...its going to stick anyways?

The Garda does not have to explain anything to you im afraid. The points stick.

The 2 points are automatic (fixed) so they always accompany a speeding ticket afaik.

I have 2 points, told the insurance and they said it wont make a differance to my premium but I was right to tell them anyways. Sure it only 2 points no big deal at all, 4 points would be a problem I am sure but try not to get anymore over the next 3 years.

Oh they always do that or they mutter about the stuff under their breath as they walk away...

Hibernian say they don't load for 2 points but they do discount for none. Go figure..

That's quite harsh for doing 1kph over the limit or were you caught doing 121 in a 100 zone?

If it was 121 in a 120 zone I'd nearly go to court and argue it. I mean it's very hard to stick exactly to 120 and going 1 kph over it wouldn't constitute dangerous driving in my mind (I know a few gardai and most of them wouldn't pull for under 130 unless it was adverse weather conditions).

You have to inform the insurer prior to the next renewal. No exceptions. It's a material fact under Insurance Law, and not to disclose it is a breach of the "utmost good faith" principle.

The fact that the insurer may aleady know (through the penalty points database) or that 2 points might not have an effect on the premium due, are not relevant.

i heard not that long ago on rte radio that the insurance companies were not linked up currently to the penalty points data base.

I've noticed this holier than thou, goody two shoes attitude a lot in this section. Very annoying.

Most insurance policies only load when you have 4 points or more. But tell them anyway.

    A lot of misinformation.

You are not any more of an insurance risk since you were caught, as you are still the same person, same car etc. So you do not have to tell anyone unless it's stipulated that you do so.

At renewal time you will be asked anyway.

Insurance law supercedes all individual contracts of insurance.

You are therefore obliged to disclose at renewal. If you are not asked, you are still obliged to disclose.

It's pretty black and white tbh.

Interesting regards insurance premiums and points.

I was online and put in that I had no points.
Then I put in that I had no points (genuine points). My second quote was lower than the one with no points. They must see it as if you have points, you are more experienced :pac:

Who is less likely to speed ?

The one who has never been caught or the one who's been taught a lesson ?

On another point, I would think that a person who is on 10 points would be the safest driver on our roads.

The OP was asking about disclosing now, not at renewal. I would be inclined to think he doesn't have to ring now, and if he did, they couldn't bump up his premium until renewal. Would you agree?

Ah gotcha. No he doesn't have to do anything now. His policy for the year was based on all material facts on the day it began.
