holiday pay due

    I worked for 10 months and didnt take a single day holiday, ranging from 24-36 hours a week. I was never able to get any holidays I wanted even when I applied 8 months previous, anyways I quit because I wanted to go away and had to since I'm going back to college and have exams soon but they didnt give me any holiday pay. Just want to get some info before I go in there and bring it up. Thanks

    Well, you may find that if you were paid continuously during your employment, that there is nothing due to you, as you never enforced or pushed to take formal leave. You are formally entitled to holiday pay after 13 weeks (subject to clarification) so that means had you taken leave then yes.

    You did however leave your employment - That would not automatically entitle you to holiday pay as far as I know.

    that website wasnt working for me, tried it on my dads comp and it comfirmed my beliefs, if you leave you are entitled to any holiday pay accrued, SNIP will be seeing me tomorrow.

    What leave was due and when did you ask for it?
    Annual leave and leaving employment

    It is illegal under the Organisation of Working Time Act, 1997 for an employer to pay an allowance in lieu of the minimum statutory holiday entitlement of an employee unless the employment relationship is terminated. In general, your annual leave is calculated on the basis of hours worked.

    If you are leaving a job you are entitled to receive payment for any outstanding annual leave and public holidays due to you.

    i had 21 days due and asked for leave for several dates. I hadnt taken a holiday despite asking for some months in advance in accordance with company policy.
