To avoid paying new council tax of 200 euro on second home, would transfer of one house to partner( therefore each owning one house) make it legally safe to not pay up?

technically no because your principal private residence is the house you reside in, ie you would each have to technically live in the separate houses to reside in your ppr. I doubt that would go down well with your other half to save 200 euro:)

thanks for quick reply. How would tax man prove we were in separate houses? as you can see I am determined to avoid this tax as I was left a house in very bad condition and need every cent to do it up. cheers.

Well they wouldn't know but you are leaving yourself open to prosecution if found out. There are many instances that one could avoid paying tax as it is a self assessment system which means it is based on honesty with the Revenue.
