Stopped for speedng

    Hi

    I was stopped for speeding this morning , I was doing 75 in a 50 zone and the guard asked me for my license and looked at it , he showed me the gun saying 75 , asked me where I was going and then said look just take it easy in future coming down that hill,

    Will I get a fine or was he letting me off , He didnt take any details down or give me anything ??

    Question for the Gardai on the forum

    Why don't Gardai who stop motorists make it clear what the next action ( if any ) will be , isn't this part of the training ?

    I know it could be the motorist in question could well be in a bit of a tizzy so may not remember afterwards , but it seems we see this question cropping up a hell of a lot on this ( and other ) forums .

    Possibly because it isn't their call. Their could be other outstanding issues that could change the final outcome.

    If someone is going to be prosecuted for an offence or offered an alternative settlement upon voluntary admission like penalty points and a fine they have to be informed of this at the earliest opportunity by whatever agency is involved in the matter. That isn't Irish law but European human rights law derived from the European Convention on Human Rights to which Ireland is a subscriber.

    So in my opinion you can safely assume that you got away with a "word to the wise" since you weren't told you were going to be prosecuted or you weren't offered a penalty points ticket as an alternative.
