Your experience with probate

    Hi, I am looking for your experience in dealing with probate. Really what I'm wondering is how long it took, did you go to a regional probate office or the general one, does it depend on anything in particular, things like that. Also, I see the courts are on a two month break, does that mean that probate office are too? :confused:

    If you are dealing with probate personally the probate office is usually quite helpful.

    NO !

    My father - non lawyer - was the executor of his late brother's estate a few years ago. The estate was straightforward and only took a couple of months to sort out.

    If you are an executor I would suggest that you move as quickly as you can because, as far as I recall, certain tax liabilities or duties might arise and you can save yourself surcharged interest if they are discharged promptly.

    Keep photocopies of every document that you complete and all your correspondence and accounts.

    If the estate is large or complex or technically convoluted it is better to instruct a solicitor at the start rather than do DIY and then have to hand it over as that can actually create more work !!
