Anther Sale of Goods question

    Right - here's one. Bought a second-hand DVD this week in a pawn shop. Quite rare movie - wouldn't get it anywhere else too easily. Went home and of course it cut out after ten minutes. Brought it back to the shop today, with the receipt - the guy tried it out on a DVD player and laptop - played alright. Refused to give me a refund - but offered me a replacement DVD of any other movie. I wanted my money back. Then he handed me a card with a list of conditions which actually stated they would refund me for selling faulty goods. The DVD was more manky than scratched but it did look like it wouldn't play. Am I entitled to a refund or should I just throw the disc in a bin?

    The goods were of merchantable quality, save as for being dirty. The broker validated that. Pawn Brokers Sell second hand goods, with tighter conditions on constructive notice usually in a form or list of conditions, some of which might negative your position.

    I don't think so. But these matters are all very circumstantial and of course subject to the terms you were accepting on purchase.

    I assume, as is the case in purchases from pawn brokers that you inspected the goods before the purchase? Normally you would also sign some waiver or docket.
