On the dole- entitled to redundancy- is it worth it?

    Hi,

    I was made redundant about 3 1/2 months ago and it was a small compnay, only a few of us. I'm an apprentice bricklayer and my boss is broke as well and on the dole. Just got the dole about 3 weeks ago and someone said to me that I should have gotten redundancy payment since I worked there over two years. I said my boss was broke and I didn't want to be harrassing him but I was told that you can get it from the social insurance fund if your boss can't pay it. I wanted to see if it was true and if I did apply for it, would I loose the entitlement to the dole? I had to wait so long that it wouldn't be worth it to loose it for a few weeks and then have to reapply.

    I don't want to be a pain in the **** for the boss and I heard that he's have to pay 40% of the money back but I was thinking I could give him the 40% and it wouldn't cost him anythin and I'd be paying off a few bills as well.

    Anyone have to do this before or any advice?

    You need to contact the Department of Enterprise,Trade and Employment regarding your redundancy question see link:http://www.entemp.ie/employment/redundancy/.
    Saying that,the local office should have asked you for your redundancy letters also.

    As the previous poster said - get in touch with the Department of Trade, Enterprise and Employment. If you have worked for the employer for more than 2 years you have the right to statutory redundancy. The employer can claim a percentage of this from the Department.

    You dont say whether your claim was for JA or JB. If for JB - the amount of redundancy will not affect your entitlement as benefit is based on social insurance contributions. If its JA depending on the amount of redundancy that a person receives - this is a means tested payment so the amount could be reduced if you go over the means threshold.... but reckon that if you are only working two years or so with this employer the amount of redundancy wont amount to much anyway.

    I worked in Redundancy for a few months so sadly I know almost too much about it. From what you've said you would be entitled to claim redundancy (worked over 2 years). If your employer has gone bust then you can claim what's called a "lump sum" which means that your redundancy will be paid from the social insurance fund, the employer is subsequently asked to pay 40% of the redundancy back to the fund, however if your employer can't pay it then he can't pay it and they won't hunt him down looking for it.

    If your claiming the dole your redundancy won't be affected, bare in mind that your redundancy package is two weeks wage for every year you worked in the company plus a "bonus week" so if you worked in the company for 3 years, at 400pw then you would get 1600 euro. Which is well worth claiming if your on the dole. Ring the redundancy payments section as others have suggested here, but bare in mind things are crazy there at the moment (as with everywhere else!!!!) so be patient with them as some of them can be very snippy!
